Brief in case Cath: Krimminger dec’d wid: of Frederick. N.C.

Fred. Krimminger. (19th Oct. 1852. Open Court.). declares he is

son of Frederick Sr & Catharine - both dead -

Sd. Fred: was a Capt. in rev: war - served in

Militia & Contl. Line - served 3 month cam-

paign in N. C. Under Genl. [Griffith] Rutherford in

1781 was before that at seige of Charles-

ton & was taken prisoner & discharged on

parole & again joined Amer: Army &

fought at battle of Camden & Guil-

ford C. H.under Genl. [Nathaniel] Green - heard his

father often say he was at Yorktown when Lord

Cornwallis surrendered & was detached to accompa-

ny him to the ship which was to carry him off.

Fred: left a widow (Cath:) who died 17th July

1843. Fred: & Cath: married in N. C. In 1782

children left Dept. & Christopher. Certified Court?

Jacob Deal. (6th Decr. 1852.) 91 yrs. Age: says he was well

acquainted with Fred Sr. - Fred was Capt.

in Regt. That marched to Wilmington against

British in 1781 commanded by Genl. Rutherford.

Deal served in Frederick’s Co. As private

when near Wilmington was dismissed by

Genl. Rutherford - out 3 months, is a pen-

sioner.

Jacob Shupign - says he was well acquainted with

Fred: Sen – he was out in a 3 month tour

to Wilmington N. C. & was Capt. in Co. in sd.

expedition - Heard Fred say he was in rev.

    in the south

Army /\ during Rev: war & was taken prisoner

in Charleston - allowed leave on parol, went

home & joined army under Genl. Green & con-

tinued in Army for some time. Dept. heard

it from him & also from a man named Kut-

ner who was with him but now dead.

Recollects well when Fred: married in 1782 -

married a woman of the name of Cath: Leferlie

recollects the day from the fact that he got a whip-

ping from his father for crying to go with him

& dept’s mother to wedding. Often heard it said

by those who were in Rev: war & by other old

men of that day that Fred was a brave

& gallant soldier.

On this the 19th day of October One thousand eight hundred and fifty two before the Said Court of

pleas & quarter sessions the same being a Court

of record, personally appeared in open court

                           aged 68 years

Frederick Krimminger /\ is resident in Said County

who being duly sworn according to law, doth

in his Oath make the following declaration,

in order to obtain the benefit of the provisions

made by the Act of Congress passed the 4th of

July 1836 & 7th of July 1838 and then supplement

that he is a son of Fredrick Kriminger Senior

and his wife Catherine Kriminger both now deceased.

He the said Frederick Krimminger Snr. was a Captain

in the war of the revolution, and served at various

periods during said war. He served both in the Mili-

tia and Continental line. He volunteered and was chosen captain of a company which he commanded

during a three month’s campaign to Wilmington, North

Carolina, which was commanded by Gen. Rutherford

in the year (1781) Seventenhundred & eighty one. That he had before that time at the Siege of Charleston was taken

prisoner that he was discharged on parole & again

joined the American army and fought at the

battle of Camden and Guilford Courthouse

under Genl. Greene. This deponent further says that

he had often heard his father say that he was at York-

Town when Lord Cornwallis surrendered and that he

was detached as one of the guard to accompany him to

the ship that carried him off. This he believes can be proven

by the records in the war department in Washington

City and in the comptroller’s office in Raleigh N. C. and

further that this declaration is sustain in a great

( mendum? ) by the ( ? ) which accompany it.

That said Fredrick Kriminger Senr. Left /\ whose

name was Miss Lyerly Catherine and that said widow died on

the 17th day of July in the year 1843 which

has been fully proven to the satisfaction of Said Court

That Frederick Kriminger and Catherine were

married in the County of Rowan and State of

North Carolina. That they were married in the year

1782 - That her name before her marriage was Catherine

Lyerly, And that when said widow died she left

     aged 66 years

two Children Christopher Kriminger /\ and Myself

this applicant. And thus he makes this declaration

for the purpose of obtaining for himself and

his ( ? ) brother named above the pension and

their said mother when she died.

the 19th Day of October 1852.

   And further it is the opinion

of the Court that Frederick Kriminger Senr.

was a revolutionary Soldier, and that Frederick

Kriminger Jr. the applicant is a man of truth

and respectability and is entitled to Credit. And

we further believe that the facts set forth in the fore-

going declaration are true - and that he served as

On this the 6th Day of December

1852 personally appeared before me Henry Miller

An acting Justice of the peace in and for Said

County & State Jacob Shupine who being duly

Sworn according to law. Says that he was well

acquainted with Fredrick Krimmger Senr. That

he he

/\ lived within five miles of him. That /\ knew well

of his being out in a three month’s campaign

to Wilmington, North Carolina. And that he was

chosen Captain of a company in said expe-

dition. I have heard him say that he was in the

                         during the revolutionary war.

American Army in the South /\ that he was taken

prisoner in Charleston and that he was allowed

to leave on his parol. That he came home and

immediately joined the army under Gen. Green

and continued in the army for some time. This

I have heard from him and a man by the name

of Kutner who was with him but is now dead.

He further states that he is 88 years of age. And

that he recollects well when Fred Kriminger was

married which was in the year 1782 that he

married a woman by the name of Catherine

Lyerlie who was a cousin of his. (R. J. Shupine)

He further states that he recollects the time of his

marriage from the fact that he received a whipping

on that day from his father for cring to go

with him & my mother to the weding. he further

states that he often heard it said by those who

were in the revolutionary war & by other old men

of that day that Fredrick Kriminger Senr. was

a brave and gallant Soldier that his conduct

was Such asto gain the approbation of his

officers and the respect of his fellow soldiers.
